There are three types of Child Custody arrangements that are commonly used in New York Uncontested Divorce cases.
Sole Custody is when the children primarily reside with one parent and that parent makes all the decisions related to health, education, religion, and welfare of the children. The non-custodial parent will have a visitation schedule.
The children primarily reside with one parent but decisions related to health, education, religion, and welfare of the children are decided by both parents together. The non-custodial parent will have the child as the paties agree and arrange or will have the child on weekends and alternate holidays.
The parents split physical custody equally and decisions related to health, education, religion, and welfare of the children are decided by both parents together. Generally each parent will have the child half of the time during any given week.
This arrangement is better suited for parents that live in the same school district, and live a short distance from one another.
Joint Custody works best when both parents are willing to put aside their differences and are able to get along for the benefit of the children.
